Curry and Comfort: Sausage and Kale Pasta

I call this a two for one meal.? Last week I posted my Sasauge and Kale Pizza and this pasta is based on the same set of ingredients with a few changes. ? My son absolutely adored this pasta and requested the leftovers for his lunch the next day. He's so funny because every time I make a creamy pasta dish it becomes his new favorite pasta.? Then I get asked for about a week when I will make it again.? Since this dish was so easy and full of nutritious kale, I will definitely make it for him very soon.

?Ingredients:
1 box fettuccine, linguine or spaghetti pasta cooked to al dente in well salted water
1lb Italian sausage (crumbled without casing)
2 cups of shredded kale (no stems)
1 medium onion chopped
1/8 tsp grated nutmeg
2 cloves garlic grated
red chili flakes to taste
1/4 cup chicken stock (or water and chicken bullion)
1/2 tsp dried basil
1/2 tsp dried oregano
1/2 grated Parmesan cheese
salt and black pepper to taste

Note: Save 1 cup of starchy pasta water if needed.?

Directions:

?Brown sausage in a pan with some olive oil.? Then add onions and garlic and saute for a few minutes.? Next add basil, oregano, red chili flakes, nutmeg, salt and black pepper. Then add chicken stock and chopped kale. Add cooked pasta and toss with Parmesan cheese. If pasta seems dry add some the starchy pasta water to make creamier. Taste for seasoning then serve hot.? Enjoy.

Intel releases Atom powered Windows 8 tablets

Expected to go on sale in October 2012

Intel has released new Intel Atom processor powered tablets operating on Microsoft's new Windows 8 operating system as well as roped in device makers including Samsung Electronics and Hewlett Packard (HP).

According to the chip maker, the new 'Atom Z2760' - formerly known as 'Clover Trail', which is expected to be on sale in October, will allow users t operate broadly deployed software including Word and Excel, as well as offering connecting capabilities to peripherals including printers.

The new tablet incorporates Imagination Technologies' PowerVR SGX545 graphics core with the Atom architecture on the Z2760 which is claimed to offer the best, low-power Windows 8 tablet experience.

Intel Mobile and Communications Group Application Processor Platforms general manager Erik Reid said this is just the beginning of the firm's effort in the tablet market, and it aims to deliver products that fit the spectrum of evolving needs of both consumers andbusiness users.

"When people or corporations buy a device with Intel Inside?, they're getting the best of Windows 8 features with a computing experience that just works," Reid said.

It also lengthens battery life, enabling tablets to run, said Intel applications processor division chief Eric Reid.

The company claims dual-core, four-thread SoC will stretch battery life and offers three weeks of connected standby while allowing more than ten hours of streaming high-definition video.

Intel's new tablets will support the current Windows applications and the security and manageability features corporate IT managers demand.

As a writer, you could say that Jonathan Ames has certainly explored the boundaries of what?s possible through a myriad of mediums and life experiences. He?s written novels, memoirs and comics, worked as a newspaper columnist, an on-stage storyteller and was the creator, writer and producer of ?Bored to Death? the TV series which ran for three seasons on HBO. He?s also been an occasional actor (he was a ?porn-extra? in one film) and had a brief career as an amateur boxer known as ?The Herring Wonder.?

Often confessional, frequently provocative and largely experiential, Ames built a reputation for putting it all out there in his writing ? whether he was sharing stories of his childhood traumas or sexual misadventures. On Wednesday, October 3 Ames will be the first guest in the fall Writers Speak Wednesdays series at Stony Brook Southampton.

Given all his successes, Ames is now in a well-earned position to offer aspiring young writers a bit of guidance in pursuing their own careers. But Ames will tell you, it was another talented (and extremely confessional) writer who inspired him when he was just starting out ? Spalding Gray, the renowned monologist and Sag Harbor resident who took his own life in 2004 following a car accident that left him with debilitating injuries.

?I first saw him in ?86 at Lincoln Center,? recalls Ames. ?A woman I was dating took me to the show, and I remember loving it. Even though it was Lincoln Center there was something Beat Generation about it. For me anyway.?

?I was 22 years old and here?s someone going up there being so vulnerable and honest and real while performing,? adds Ames. ?A few years later, I don?t know if I forgot about it, but I began to tell stories.?

By that point, though Ames had published his first novel, ?I Pass Like the Night,? he was struggling with his new writing projects. So he went to MacDowell Colony, an artists and writers retreat in New Hampshire, where he had received a residency. Coincidentally, Spalding Gray had also once had a MacDowell residency (he shared details of the writer?s block he experienced there in his monologue ?Monster in a Box?). And like Gray, Ames found he was also having trouble getting his words down on paper during his time at MacDowell.

?But when I was talking at the dinner table they?d all laugh,? recalls Ames of the other artists and writers at MacDowell. ?Same things at the support groups, I?d tell my stories and they laughed.?

?One night I ended up telling stories at the library in the colony,? he adds. ?I don?t know if I had Spalding in my mind, but he was in my conscious.?

That was 1990, and in the years that followed, Ames began to go on stage to tell very personal stories from his life. But these were not like stand-up comedy routines or theatrical one-person shows that involve a lot of movement on stage.

?I kind of did what Spalding did with the desk and the glass of water ? stripped down and talking at a mic,? explains Ames. ?Then in ?99, I met him socially at a party and was very shy, a little like a baseball fan seeing Joe DiMaggio or Derek Jeter. I asked if his technique was like mine, where he knew the basic outline, but used improv so he told it fresh every time. He said he did.?

In 1999, Ames received a Guggenheim fellowship and brought his original (and some would say shocking) one-man show ?Oedipussy? to an off-off-Broadway theater. And by the time of Gray?s death, Ames had become known as a downtown Manhattan performer and he knew a lot of the same people as Gray. So when Gray?s widow, Kathie Russo, and Lucy Sexton put together the theatrical piece ?Spalding Gray: Stories Left to Tell,? which consisted of excerpts from Gray?s monologues and writings, they tapped Ames as one of the initial five performers to share Gray?s words on stage.

?After a few experimental performances in small theaters I was in the PS 122 run,? says Ames. ?We did five nights in a row, then I went on the road with them to a couple different cities and theaters.?

While Ames would not say his own method of baring his soul on stage was directly because of Gray, he does call him ?a kindred spirit.? And though he performed his on stage pieces while still working on his books, Ames did not find that one form of writing segued into the other.

?It was a dual track ? I?d write during the day, perform at night,? he says. ?The performance was more ephemeral, more of the moment. Later I had a column in an alternative paper for three years. A lot of the stories I told on stage I turned into prose for my column. My column was my adventures.?

?For me, performing grew out of struggle to write a second book ? but I found I could just talk,? he says. ?That led me back to writing. It was this bifurcated life. I was better known as a writer than a performer. In the downtown world I was known as both.?

Now that he?s older (Ames is 48), finds his focus has changed and he admits he is less eager to share the nitty gritty details of his personal life with his public. In the HBO series ?Bored to Death,? actor Jason Schwartzman may have played a struggling novelist named Jonathan Ames who moonlights as an unlicensed private detective, but the show, which ran from 2009 to 2011, was wholly fictional ? not confessional.

?I?ve written four novels and four collections,? he says. ?I haven?t really been doing the confessional work for quite some time. As I get older it becomes more difficult because I think I want to be more private and don?t want people reading into things as much.?

?It?s an issue I?m struggling more with now than when I was young and more courageous on some level,? says Ames. ?When you?re trying to make your way, you do that by being brave. Maybe I?ve gotten less brave.?

It?s not just true of the writing. Ames, a.k.a. ?The Herring Wonder? who once enjoyed going a few rounds in the ring, whether in the school yard, as performance art spectacle or a serious amateur bout, has also hung up the boxing gloves. His nose has been broken more times than he cares to remember.

?I haven?t had a fight since 2007. I don?t think I?ll box again,? he says. ?I enjoyed the romance of getting into the ring, but not getting hit or hurting someone else. I was more into putting on the costume.?

Celebrate National Drink Beer Day | Triangle Arts and Entertainment

Great news!?Today is National Drink Beer Day, so you?ve got a built-in excuse to go celebrate (you?re on your own the other 364 days of the year!) Some of my friends have no problem trying different types of beer (me neither) and that?s a good thing because our taste buds will never get bored. But, if you?re like many of my other friends who stick to the same style and brand of beer day in and day out, I urge you to get out of your rut and try something different to broaden your horizons or at least your palate. And it just may be easier on your pocketbook, since so many bars and restaurants have different daily beer specials that can save you some cash while you?re trying something new.

Beers are categorized into two groups, lagers and ales, depending on the types of yeast and temperatures used dur?ing their cre?ation and fermentation. Lagers use a yeast that fer?ments best at cool tem?per?a?tures, while ales use a yeast that fer?ments better at warmer temps. There are a number of good websites that explain all the different types of beers so, rather than reinvent the wheel, here are some of my favorites. The Beer Pros have a great page, Beer 101, which is short, to the point and can be found at: http://www.thebrewbros.com/beer-101/. I also love the BeerAdvocate?s website (http://beeradvocate.com/), which is full of great information found in its magazine by the same name, and more.

If you live in Raleigh and are looking for a wide selection of beers, either on tap or bottled/canned, luckily there are numerous places for you to choose from and far too many for me to list. Here are some of my favorites, in no particular order, along with some bar food recommendations in some cases. Keep in mind that many of these bars offer beer flights, which are a specific number of small pours, usually 5 ounces, from a predetermined menu. Some places will let you design your own flights, and either way it?s a great way to sample new beers!

Flying Saucer (328 W. Morgan St., Raleigh, N.C. 27601)

Join the UFO club for $18.00 and get a t-shirt and a card to track what you drink. Once you hit 200 different beers you?ll be inducted into the ring of honor with a plate party and $100.00 to spend on beer and food! Love the big soft pretzels and the wings. Great outside seating!

**Note ? since I posted this I?ve learned that Flying Saucer no longer gives you the $100.00 for your plate party. Sigh. Glad Brad and I had ours years ago!

Brickhouse (3801 Hillsborough Street, Raleigh, N.C. 27607)

Bar Goddess Maddie takes good care of Brad and me, so that?s one of the reasons this place is on my list. It?s close to home, has more than 40 beers on tap and lots of big screens (some could use upgrading) to watch sports, especially anything Wolfpack! Good outside seating, especially if you don?t mind trains. I have not eaten here since it became the Brickhouse, so I have no food recommendations. I do love its Bloody Marys as well!

Tyler?s Taproom (18 Seaboard Ave., Raleigh, N.C 27604)

Tyler?s recently opened in Raleigh and has more than 80 beers on tap, plus a bottle shop to purchase beers to take home. Nice outside seating, great food. I especially like the Carolina Nachos and the fried green tomato, pimento cheese BLT. Yum!

Village Draft House (428 Daniels St, Raleigh, N.C. 27605)

Located in Raleigh?s Cameron Village Shopping Center, the Draft House has 99 beers on tap. I love its fried pickles and spinach/artichoke dip, but am quite upset that the potato skins are off the menu. Why did they do that? This place is normally packed at lunch and has outside seating. Nice place to stop for a beer if you?re in the Village shopping.

World of Beer (4208-150 Six Forks Rd., Raleigh, N.C. 27609)

WOB recently opened in Raleigh?s trendy North Hills and is a franchise that has many U.S. locations. Brad and I visited it for the first time just last weekend and there was a good crowd enjoying beer in its outside seating area since it was such a beautiful evening. Good beer selection, with live music Thursday-Saturday nights. I?m not sure that WOB serves food ? I didn?t see any menus in the bar or on its website. We stopped to check it out on our way to Fox and Hound, which is right across the street, and I can see going back again.

Fox and Hound (4158 Main At North Hills St., Raleigh, N.C. 27609)

Fox and Hound is part of a national chain, and a great place to watch a game. I?ll never forget one afternoon a few years ago I was shopping at North Hills and planned to meet Brad here to watch the second half of some college football games. I arrived early and was so lucky to grab two stools at the bar, right in front of TVs that were showing the NCSU and ECU games, which were the two we wanted to see! Love the potato skins here, which I posted about several months ago.

Carolina Ale House (various locations in Raleigh and surrounding area)

CAH has lots of North Carolina brews on tap. It?s a great place to watch sports or take the kids for a meal, and the food is pretty decent. Gabe and Lexi love the wings and I can recommend the Carolina Dipper and the Ale House Chili Nachos (also one of Brad?s favorites), which you will want to share. I tried the seasonal flight with some great Oktober-fest type beers.

Draft Carolina Burgers and Beers (510 Glenwood Ave, Raleigh, N.C., 27603)

Great selection of North Carolina beers, fantastic potato skins and awesome burgers ? some of the best I?ve had in Raleigh as noted in my burger and potato skins blog posts. That?s basically all you need to know. Go there and enjoy!

My favorite store with an awesome beer selection is the Peace Street Market (804 W. Peace St., Raleigh, N.C. 27605)

It may not look like a beer haven from the outside, but inside there are three long walls of coolers filled with various brands of beer, not to mention the nonrefrigerated aisles of brew. The Market carries growlers for the local breweries. This is probably the best beer selection in Raleigh!

However, if you can?t get downtown, Whole Foods (various locations) has a good craft selection.

So there you go ? no matter what your taste is in beer, you will probably find something to satisfy it in Raleigh. BTW ? many thanks to Brad for helping me with my research. I?m pretty sure he didn?t mind!

France unveils a budget heavy on taxes

PARIS (AP) ? The French government presented a budget Friday that was heavy on taxes ? including a controversial 75 percent income rate on high earners ? but which critics said lacked fundamental reforms that could jumpstart economic growth.

President Francois Hollande's cabinet defended the spending plan for next year, calling it a "fighting budget" that would win the "battle" against joblessness and help growth.

Like many European countries, France must tread a fine line between cutting the debts that dragged them into the current financial crisis and investing in the economy to spur growth.

The French economy, the second largest among the 17 countries that use the euro, has not grown for three straight quarters, the national statistics agency confirmed Friday. Its gross domestic product stands at ?1.8 trillion ($2.2 trillion). Unemployment has been on the rise for more than a year and stands at 10.2 percent.

Economists warn, however, that things could get much worse in France if it doesn't get serious about slashing state spending and reforming stringent labor laws.

"This is a serious budget, it's a leftist budget and it's fighting budget," Finance Minister Pierre Moscovici told French radio station Europe-1 Friday morning.

Because Hollande promised that he would slash the country's deficit to 3 percent of its GDP next year ? a limit required by European rules ? the government must find ?30 billion in savings. One-third will come from spending cuts. The rest will come from new or higher taxes on the wealthy and big companies, including a new 75 percent tax on earned income that exceeds ?1 million.

Among the other measures included are a new income tax level at 45 percent for those making more than ?150,000 ? the current top rate of tax is about 41 percent for income above ?70,000. Also included in the budget is an increase of capital gains taxes, which start around 19 percent, to bring them more in line with how salaries are taxed, and a cap on certain deductions for large companies on their income taxes.

The 75 percent tax will last for two years and has always been billed as a symbolic measure since it will bring in very little revenue. Several businessmen and politicians in the opposition have said that's exactly what's wrong with the 2013 budget: It sends the message that France doesn't like the rich and isn't open for business.

"France is sick from a model that isn't viable," said Guillaume Carou, CEO of Didaxis and president of the Club of Entrepreneurs, which represents 15,000 small businesses. "But (the government has) chosen to keep it, that's what the 2013 budget reveals."

Prime Minister Jean-Marc Ayrault rejected that characterization, however, insisting that the budget would win the battle against unemployment.

"It's a budget that aims to inspire confidence and to break the debt spiral that keeps growing and growing," he said after the budget was presented to the Cabinet.

The budget is built around an expectation of 0.8 percent growth for next year. If growth misses the projections, more cuts could be needed later.

Moscovici conceded that most economists predict the French economy will grow just 0.5 percent, but said that if the European debt crisis stabilizes, France would meet its targets.

Big Quakes Signal Changes Coming To Earth's Crust

On April 11 of this year, an extraordinary cluster of earthquakes struck off Sumatra. The largest shock, magnitude 8.7, produced stronger ground-shaking than any earthquake ever recorded. And it surprised seismologists by triggering more than a dozen moderate earthquakes around the world.

The quakes are also a sign of big changes to come in the Earth's crust.

But chances are you don't remember the April 11 quake off Sumatra. That's because it was far offshore, so nobody got severely shaken, and it didn't produce a killer tsunami. But the event didn't simply fade away for Ross Stein at the U.S. Geological Survey in Menlo Park, Calif.

"I was having dinner with my wife at a restaurant a few hours after this earthquake had occurred, and I kept getting paged," Stein says. "And I would look and see that a large earthquake had occurred somewhere around the world. And it just seemed very, very odd that we were having this run of earthquakes of magnitude 5 and larger in this short space of time."

And Stein's pager didn't stop after dinner. It kept going off for nearly a week, because moderate quakes kept popping up all around the world.

As Stein and his colleagues report in Nature magazine, the big quake triggered 16 moderate quakes. That defies conventional wisdom. Big quakes trigger big aftershocks locally, but the distant quakes they trigger are typically tiny.

It turns out this was no ordinary quake.

"The shaking produced by this earthquake is larger than any other earthquake recorded, even though we have earthquakes such as the magnitude 9.2 event in 2004, which is 10 times larger than this one," Stein says.

The energy from this quake was all released in about two minutes, compared with eight minutes for the quake that triggered the deadly Indian Ocean tsunami in 2004. And while most quakes of this size move the ground up and down ? which can cause tsunamis ? ground movement during the April quake was side to side.

"This is the largest strike-slip, or San Andreas-like earthquake ever recorded," Stein says.

The shock sent a series of long seismic waves around the world, shaking the ground horizontally and ringing the planet like a bell. Those are called Love waves, and Stein suspects they were strong enough to trip quakes on faults that were pretty close to failing to begin with ? not creating new hazards, just changing the timing of quakes.

And the story here isn't just about distant quakes. Seismologists studying the April 11 quakes themselves were also in for a surprise.

"The main shock, the 8.7 event, ruptured on four different faults, which is really unusual," says Thorne Lay, at the University of California, Santa Cruz. He and his colleagues describe this in a separate paper in Nature. Lay's team found that the quake zigzagged through a hash mark of faults. And the quakes themselves were not where anybody expected them to be.

"They didn't happen where we typically observe very big earthquakes," Lay says. "It was not on the boundaries between tectonic plates, where plates are rubbing against each other."

Instead, Lay thinks we're witnessing the gradual evolution of a new boundary between tectonic plates.

Here's the big picture. Australia and India sit on the same vast chunk of rock, along with a large swath of the sea floor. This makes up one tectonic plate, "and it's all been moving together northward pretty much coherently for many tens of millions of years," he says.

The western half of that plate has run up against Asia. That slow-motion collision is pushing up the huge Himalayan mountain chain. But the other half of that plate, to the east, is still moving north, unimpeded.

"One part got stuck," Lay says. "The other part kept going. And that sort of wrenched the plate."

That wrenching spot is where the April 11 events took place. Over millions of years, Lay figures, a new plate boundary will form there.

"This event is a very tiny step in that evolution. But it's geologically fascinating to actually be able to record it in our lifetimes and see that process going on," he says.

The new plate boundary will appear only after thousands of more quakes like the ones in April tear up the rock and shift the stresses that are constantly reshaping our planet.

Using an advanced 3-D time-lapse imaging system, a group of physicists and plant biologists from Cornell University and the Boyce Thompson Institute for Plant Research have discovered how certain plant roots exhibit powerful mechanical abilities while navigating their environment.

The research, published in this week's online Early Edition of Proceedings of the National Academy of Sciences, could eventually assist in breeding crop plants optimized for growth in areas where climate change or over farming has led to difficult soil conditions.

The researchers grew Medicago truncatula plants in a transparent gel consisting of two layers ? a soft, top layer and a stiff, lower layer. The roots grew straight down until reaching the lower layer, where they began to twist and buckle into spring-like shapes, much like a string begins to curl if it's continuously twisted in one direction.

Combining 3-D movies with measurements and mathematical modeling, the research sheds new light on root growth revealing the role mechanics plays in determining the root shapes. Ultimately, this led to a previously unknown connection between root geometry, growth, and force generation.

"When the roots hit the stiff barrier, growth causes them to buckle like a wire or rod that's been compressed. But by twisting, the buckled roots become helical, allowing the root to push off more gel and get more force at the tip," said Jesse Silverberg, a Cornell graduate student in the Department of Physics and lead researcher for the study.

"Suppose the plant is growing along and finds itself stuck at a layer of clay or tough clump of soil. The root needs an extra force to push through these barriers, and the mathematical model tells us how large of a helix the root needs to grow to do just that. Roughly, the stiffer the barrier, the larger the helix," said Silverberg.

The researchers also used the 3-D technology to discover that 74 percent of the plant roots twisted in a counter-clockwise manner. Silverberg says further research may reveal similar behavior in other plant species.

Yemen leader says would talk to disarmed al-Qaida

SANAA, Yemen (AP) ? Yemen's president said Tuesday he would talk to his country's branch of the al-Qaida militant network if it were to give up its weapons, abandon its extremist ideas and stop sheltering foreign fighters.

The televised statement by President Abed Rabbo Mansour Hadi appeared aimed at showing his readiness to use any means to reduce the political violence in his country, home to the most world's most active branch of the terror network. Al-Qaida however has shown little indication that it would want to pursue a dialogue, especially under Hadi's conditions.

The militants had taken advantage of Yemen's popular uprising last year to seize much of the country's south. This summer, backed by U.S. advisers and drones, Hadi's military launched an offensive to reclaim this territory, going after al-Qaida's strongholds and hideouts. The groups' No.2 was killed earlier this month in an airstrike.

The militants in turn have struck back, targeted security officials for assassinations and staging deadly bombings.

Hadi's remarks were in line with the image he tries to project, of a leader serious about bringing stability to his country either by force or by negotiation.

He said he was pressured by unidentified local "mediators" to accept the idea of dialogue with the militants. The group has often found shelter among tribal leaders.

"I say, despite the heavy blood that was shed and the homes which were destroyed, and people who lost their homes, a dialogue can be started on condition that the al-Qaida agrees publicly to hand over its weapons, declares its repentance from its extremist ideas that have nothing to do with Islam and gives up sheltering armed groups from outside Yemen," he said. "Then this would be opening the door for dialogue."

He added, however, that "mediators go and never come back," indicating skepticism that al-Qaida would ever take up the offer.

Al-Qaida in the Arabian Peninsula has planned attacks against targets in both Yemen and the United States., including the failed attempt by an al-Qaida operative to detonate a bomb in his underwear aboard a flight bound for Detroit on Christmas Day, 2009.

In May, nearly 100 Yemeni soldiers were killed when a suicide bomber blew himself up at a parade rehearsal. Al-Qaida said at the time it was targeting the defense minister, who was the target of at least six assassination attempts. At least 13 people were killed in the latest attempt against the minister two weeks ago in Sanaa.

Hadi's predecessor Ali Abdullah Saleh was long accused by critics of not fighting al-Qaida wholeheartedly. Saleh stepped down in February in a power transfer deal backed by the U.S., but Hadi and his supporters complain the former leader undermines security using relatives and loyalists still in key positions.

On Tuesday, Hadi vowed to continue to free the country from "burden of the past," an apparent reference to his predecessor's alleged meddling. "All I promise is that I will not be silent or objective before whatever curtails the path to change," he said.

The impoverished Arabian Peninsula nation's economy has been hard hit by the upheaval.

On Tuesday, an explosion struck a gas pipeline in southern Yemen, temporarily halting the flow of gas although exports were not affected, a government official said. The pipeline has repeatedly been targeted by groups suspected to be affiliated with al-Qaida.

An oil ministry official said repair work has begun in the Liquefied Natural Gas Co. pipeline. He spoke on condition of anonymity because he was not authorized to speak to reporters.

The bombing in Shabwa province comes on the heels of a Monday attack against an oil pipeline nearby.

A statement by the gas company said nobody was hurt in Tuesday's explosion. Yemen LNG Co. was created in 1995 ? the country's first natural gas liquefaction consortium. Its major shareholders include French oil company Total SA and Dallas-based Hunt Oil Co. It also is backed with Asian, U.S. and Yemeni government funding.

Ex-Guatemalan commander linked to massacre to stand trial in U.S.

LOS ANGELES (Reuters) - A former Guatemalan Army commander suspected in a notorious massacre during the country's civil war has been ordered to stand trial in the United States on charges he lied about his past to gain U.S. citizenship, prosecutors said on Tuesday.

Jorge Sosa, who was extradited to the United States from Canada last week, was ordered held without bond during a hearing on Monday in U.S. District Court in Riverside, California, Assistant U.S. Attorney Jeannie Joseph said.

Joseph said a November 27 trial date had been set for Sosa, who has been accused of taking part in the Guatemalan civil war massacre at Dos Erres, a farming village where 250 men, women and children were brutally slain by military commandos in 1982.

U.S. prosecutors have no jurisdiction in Guatemala and have not charged Sosa, also known as Jorge Vinicio Sosa Orantes, in connection with the Dos Erres killings that are considered one of the worst atrocities in that country's bloody, 36-year civil war.

Instead, he is charged with making false statements to immigration officials to cover up his past as he sought to become a naturalized U.S. citizen in 2008. If convicted, Sosa could be sent to Guatemala after serving his U.S. sentence to face potential charges there.

Law enforcement sources say Sosa, who has been living in the Riverside area, fled to Canada when he learned he was under investigation. Riverside is about 60 miles east of Los Angeles.

An attorney for Sosa could not immediately be reached for comment. The ProPublica news service has reported that Sosa denied guilt in a recent interview from jail in Canada.

According to a U.S. federal grand jury indictment issued in September 2009, Sosa was a commanding officer of a Guatemalan Army special forces unit known as the Kaibiles that killed nearly everyone living in tiny Dos Erres, many by hitting them with a sledgehammer and dumping their bodies into a well.

Many of the women and girls of the village were raped before they were slain.

The Kaibiles unit had been dispatched to Dos Erres to find members of a guerrilla group that had ambushed a military convoy in November 1982, killing soldiers and taking their weapons.

One of two known survivors, 33-year-old Oscar Ramirez Castaneda, was granted political asylum on Monday in the United States, according to his attorneys.

Castaneda, who learned only last year that he had been abducted as a young boy by a Guatemalan army lieutenant during the massacre and raised by the man's family, was assisting prosecutors in cases against former members of the Kaibiles.

Sosa is the fourth former Kaibiles member living in the United States to be targeted by the U.S. Immigration and Customs Enforcement's Human Rights Violators and War Crimes Center. (Editing by Tim Gaynor and Philip Barbara)

Apple says more than 5 million iPhone 5s sold

NEW YORK (AP) ? Apple Inc. said Monday that it has sold more than 5 million units of the new iPhone 5 in the three days since its launch, less than analysts had expected.

Apple shares were down $15.31, or 2.2 percent, at $684.79 in premarket trading.

The iPhone 5, the most eagerly awaited phone of the year, went on sale Friday in the U.S., Germany, France, Japan and five other countries.

When it launched the iPhone 4S a year ago, Apple sold 4 million in the first three days.

Apple could have sold more iPhones if it had more available: demand exceeded supply for most models. Topeka Capital Markets analyst Brian White said the phone was sold out at 80 to 85 percent of the U.S. Apple stores he and his team contacted Sunday evening, and the ones that were still available were mostly Sprint models.

Online delivery times have stretched to three to four weeks.

White had expected Apple to sell 6 to 6.5 million iPhone 5 units in the first three days.

The phone will go on sale in 22 more countries this Friday and in more than 100 countries by the end of the year.

Is "Illegal Immigrant" "Inflammatory, Imprecise, And ... Inaccurate"?
That's what Jose Antonia Vargas writes in TIME:

Add that to the list of questions I am repeatedly asked since publicly disclosing my undocumented immigrant status in the summer of 2011. Calling undocumented people "illegal immigrants" -- or worse, "illegal aliens," as Mitt Romney did in front of a largely Latino audience last week -- has become such standard practice for politicians and the media, from Bill O'Reilly to the New York Times, that people of all political persuasions do not think twice about doing it, too.

But describing an immigrant as "illegal" is legally inaccurate. Being in the country without proper documents is a civil offense, not a criminal one. (Underscoring this reality, Justice Anthony Kennedy wrote for the majority opinion on SB 1070, Arizona's controversial immigration law: "As a general rule, it is not a crime for a movable alien to remain in the United States.") In a country that believes in due process of the law, calling an immigrant "illegal" is akin to calling a defendant awaiting trial a "criminal." The term "illegal" is also imprecise. For many undocumented people -- there are 11 million in the U.S. and most have immediate family members who are American citizens, either by birth or naturalization -- their immigration status is fluid and, depending on individual circumstances, can be adjusted.

When journalists, who are supposed to seek neutrality and fairness, use the term, they are politicizing an already political issue. (How can using "illegal immigrant" be considered neutral, for example, when Republican strategist Frank Luntz encouraged using term in a 2005 memo to tie undocumented people with criminality?) And the term dehumanizes and marginalizes the people it seeks to describe. Think of it this way: In what other contexts do we call someone illegal? If someone is driving a car at 14, we say "underage driver," not "illegal" driver." If someone is driving under influence, we call them a "drunk driver," not an "illegal driver." Put another way, how would you feel if you -- or your family members or friends -- were referred to as "illegal"?

Well, since those friends of mine who emigrated here from other countries went through hell to do it legally, having to go through long and awful processes in a couple cases, that would really suck.

I looked up "illegal" in the Apple dictionary (on my computer):

illegal |i(l)?l?g?l| adjective

contrary to or forbidden by law, esp. criminal law: illegal drugs.

noun
an illegal immigrant.

And yes, it really does give that example.

It is illegal to cross our borders and enter this country without permission. Thus, it seems correct to call someone who does so an "illegal immigrant."

This differentiates them from people who follow the law -- i.e., legal immigrants.

We don't call people illegal hijackers, illegal home-invaders or illegal muggers because there are no legal hijackers, home-invaders or muggers.

Also, a commenter at TIME, Talendria, points out that the only violation of our laws usually isn't just at the border crossing:

When people use the term "illegal," they're typically not referring to a visitor who overstayed his visa accidentally or on purpose. They're referring to people who willfully engaged in illicit activity to sneak into the United States, obtain a job, and benefit from social services because they knew they weren't eligible under the existing immigration laws.

While I'm not an expert in criminal law, I'm guessing all of the following activities are illegal to some extent:
--forging documents
--buying forged documents
--using forged documents to obtain a job
--driving without a valid license
--driving without insurance

There are additional activities which may not be strictly illegal but are still harmful:
--enrolling non-citizens in public schools
--taking advantage of social services meant for citizens (food, housing, health care)
--taxing the legal system (police call-outs, court appearances, prison)

I think people cling to the term "illegal" even though they know it sounds uncharitable because they're offended by the blatant disregard for our laws and the apparent lack of concern for the social and economic consequences of breaking those laws.

I personally would love to find a way to resolve this problem to everyone's satisfaction, but you've drawn your line in the sand so far to the left that it's difficult to find any common ground.

P.S. It's a felony in Mexico to be an illegal immigrant. (I don't speak Spanish, but I'm guessing they don't use a frilly, P.C. term for it, either.)

Drama, controversy marked the first Supreme Court justices

It was 223 years ago today that Congress signed the law that created the Supreme Court, and a look back at the first court shows personal drama that included a justice dodging creditors, a failed suicide attempt and a Chief Justice who was America?s most-hated man, for a time.

The framers had made provisions for the court in Article III, Section 1, of the Constitution, but it took the Judiciary Act of 1789 to make the court a reality.

In the first session ever in Congress, lawmakers passed Judiciary Act on September 24, 1789, which established the framework for the Supreme Court, as well as circuit and district courts and the Attorney General?s office.

President George Washington named six Supreme Court justices who were approved within two days by Congress.

On February 1, 1790, the first session of the U.S. Supreme Court was held in New York City?s Merchants Exchange Building.

By then, the court had already lost a justice and two other justices missed the session because of transportation problems.

It wasn?t the first problem for the first Supreme Court.

The court?s creation was controversial, as the Anti-Federalists thought it would be too powerful. However, Alexander Hamilton argued in the Federalist Papers that the court had a critical role as a check against legislative and executive abuse.

?Whenever a particular statute contravenes the Constitution, it will be the duty of the judicial tribunals to adhere to the latter and disregard the former,? Hamilton said in Federalist 78.

His point was later settled in the historic Marbury v. Madison ruling in 1803, which gave the Supreme Court the ability to overturn congressional acts it deemed as unconstitutional.

A completely different Court than today?s

The? first Supreme Court, named by President Washington when he signed the Judiciary Act, would be most unusual today, in its behavior and temperament.

The court had just six justices with the aforementioned undefined powers, and definitely a few personal issues. The Supreme Court justices were also required to ?ride circuit,? and hold hearings twice a year in one of three judicial districts.

The first Chief Justice was John Jay, and the associate justices were John Rutledge, William Cushing, John Blair Jr., Robert Harrison, and James Wilson.

Jay had written part of the Federalist Papers, but his role as the first Chief Justice included two campaigns for governor in New York (while he was still a justice) and the controversial Jay Treaty with Great Britain.

The treaty Jay negotiated, while he was still the Chief Justice of the Supreme Court, was highly unpopular. We can?t repeat some of the words used in public about Jay, who was seen as favoring the British as a negotiator, but here is a typical quote that appeared in New York or Boston:

?Damn John Jay! Damn everyone who won?t damn John Jay!! Damn everyone that won?t put lights in his windows and sit up all night damning John Jay!!!?

The Chief Justice later said he could find hid way across the country by the light of his burning effigies.

Jay left the court in 1795 after finally winning a gubernatorial election. The court had heard very few cases since 1789 under his leadership.

John Rutledge was at the Constitutional Convention and an important figure in South Carolina when he was first named to the Supreme Court. He served two years on the bench and quit in 1791, without hearing a case.

President Washington then asked Rutledge? to return as Chief Justice to replace Jay in 1795 while the Senate was in recess, and Rutledge heard two cases during that time. However, the Senate rejected Rutledge?s permanent nomination after he publicly criticized the Jay Treaty with some inflammatory language (he compared it to prostitution).

Rutledge jumped off a wharf in Charleston in a failed suicide attempt after he heard about the Senate vote (he was rescued by two slaves who saw the incident). His public career was over.

A justice on the run

James Wilson was also a key player at the Constitutional Convention who had a troubled career after joining the high court.

Wilson was a leading legal theorist, but he was also troubled by bad debts after getting involved in some land deals. Wilson was imprisoned twice for bad debts while he served on the Supreme Court, and he missed several court sessions as he avoided bill collectors.

Wilson died in 1798 while still on the bench. He was staying at the house of a friend in North Carolina, out of the reach of creditors, and riding the Southern District court circuit.

William Cushing was the longest-serving justice appointed by Washington, and he remained on the court until 1810. But Cushing rejected the job of Chief Justice in 1796 even though Washington nominated him and the Senate had unanimously approved the nomination. (Perhaps he saw what happened to Jay and Rutledge.)

John Blair Jr. was a highly regarded jurist from Virginia who served on the court until 1795, while Robert Harrison immediately declined his appointment from President Washington and was replaced with James Iredell in 1790.

Iredell was the friend that James Wilson was visiting in North Carolina for an extended period in 1798, when Wilson died. Iredell would die the following year at the age of 48, and historians cite the rigorous job of ?riding circuit? as a cause of Iredell?s death.

Iredell traded his southern route with Wilson as a favor, and traveled from North Carolina to the court?s Middle Circuit, which ranged from Virginia to New Jersey and Philadelphia. (One historian speculates that Iredell might have had another motive: He had grown close to Wilson?s young wife in Philadelphia.)

The Supreme Court would find stability with the appointment of John Marshall as Chief Justice in 1801 by outgoing President John Adams.

Marshall was the second choice for the position. Adams initially asked John Jay to return, but Jay refused. He said the Supreme Court lacked ?energy, weight, and dignity.?

US routs Australia in Sundhage's farewell game

COMMERCE CITY, Colo. ? On her final victory lap, Pia Sundhage hopped and high-stepped her way around the field.

As the U.S. women's national soccer team coach soaked in the cheers from the capacity crowd, her team began serenading her by belting out, "You are my Sunshine."

A fitting tribute since Sundhage has had the squad in perfect harmony for five years.

A fitting way to go out, too.

Abby Wambach broke a tie early in the second half and Alex Morgan added two goals and two assists, helping the U.S. beat Australia 6-2 Wednesday night in an international friendly that was Sundhage's farewell game.

"Today is Pia's day. We've been talking about it all day: What can we do to show her?" Wambach said. "She's a passionate woman about this game. We knew the best thing we could do was give her a win."

Sundhage announced earlier this month she was stepping away after leading the squad to back-to-back Olympic gold medals. She will return home to coach the Swedish national team.

Heather O'Reilly, Shannon Boxx and Sydney Leroux also scored for the Americans, who move to 21-0-2 against Australia.

The Australians went ahead 2-1 late in the first half on Sarah Walsh's low shot past Hope Solo. A few minutes later, Morgan tied up the game.

Wambach deflected in the decisive goal in the 53rd minute when she simply stuck her foot out after Morgan unleashed a shot.

And with that, the team was on its way to sending Sundhage out in winning fashion.

Sundhage leaves after a highly successful stint, going 91-6-10 in her time on the bench. Besides two Olympic gold medals, she also led the Americans to their first World Cup final in 12 years.

"She's built this game, helped elevate the game to a new level," said Solo, whose team won its 14th straight match. "So, there's not too much to be sad about. Of course, we're heartbroken that she's gone. But she's fulfilling her dreams and we're going to fulfill ours."

As a goodbye present, the team recently gave Sundhage a guitar that was signed by all the players in - surprise, surprise - the color of gold.

"It's the best present I ever got," she said.

They gave her quite a few memories along the way, too.

Sundhage's most poignant? That's easy: When the team roared back against Brazil in the quarterfinals of the 2011 World Cup. Wambach tied it at 2 with a magnificent, leaping header in the 122nd minute. The U.S. eventually captured the match 5-3 on penalty kicks.

"Better than a movie," Sundhage said. "That is the moment of my soccer life."

This final performance wasn't too bad, either.

Morgan's performance against the Australians gives her 63 points this year. It's the most for a national player in a calendar year since 2004, when Wambach accounted for 75 points.

"We wanted to give her a good show," Morgan said. "We didn't have the right rhythm in the first half. We're happy that we got a win in Pia's last game."

After the match was over, Sundhage hugged everyone in sight. She also began signing through tears - Tina Turner's classic, "Simply the best."

It was a day of singing for Sundhage, who performed tunes in the pregame meeting as well. The song list included: "The Times They Are A-Changin" and "Leaving on a Jet Plane."

Sundhage came in singing and left the same way.

"When a coach comes in and you don't know who they are and they start singing songs to you, it's like, `What is this going to be? How is this going to go?"' Wambach said. "Thankfully, it went well. It turned out really well for us."

Over Sundhage's career, she has made a habit of jotting down notes filled with emotions and tactics. Lately, she's been looking back at those details, to remember how special these players were to her.

The feeling was mutual.

Midfielder Carli Lloyd is convinced she might not be wearing the red, white and blue if not for Sundhage, who changed the way the team played after taking over. Sundhage emphasized midfield play even more, making Lloyd a vital component.

"When Pia first came on, she saw me play in previous tournaments and said to me, `I really like how you play and really believe in you,"' Lloyd recounted. "From then on, she preached playing in the midfield, playing possession. That's right up my alley."

Now, the big question is who replaces Sundhage?

U.S. soccer federation president Sunil Gulati recently said a search committee has been assembled - one that includes former U.S. team standout Mia Hamm - and a replacement could be selected possibly next month.

"Heard they have it down to double-digit (candidates)," Solo said. "But I don't know who it's going to come down to."

A new voice will take some getting used to for the players. They're used to Sundhage's fun-loving demeanor. She laughed with them. She played guitar for them.

After O'Reilly's early goal, the team went over to Sundhage on the bench and played air guitar for her.

"If you look at her statistics alone, she's done a fabulous job," Lloyd said. "But it's not only stats; it's the way she is as a person. She brings so much joy and pleasure. It's contagious, the way she has so much passion for the game."

Morgan earned her first cap while playing for Sundhage. Now, she's one of the most recognizable faces on the team and younger kids frequently show up in the stands wearing her jersey.

"Pia has done so much for us. We really appreciate everything," Morgan said. "It's not typical that you send off a coach like this - on such a high note and such a happy note."
